Securing your purchase or sale

Before anything is signed, we check the legal status of the property: land title, registered charges (mortgages, seizures, easements), planning compliance and the identity of the sellers. For unregistered land, we assess the strength of the ownership deeds (Moulkia) and the risks involved.

We draft or review sale agreements and deeds, and follow the transaction until your right is recorded at the Land Registry (Conservation foncière).

Our areas of practice

  • Purchase and sale of residential, commercial property and land
  • Off-plan sales (VEFA) and disputes with developers
  • Land registration and objections
  • Co-ownership: by-laws, general meetings and disputes between owners
  • Residential, professional and commercial leases
  • Inheritance and division of real estate
  • Property investment by Moroccans abroad and foreign buyers

Property disputes

When a dispute arises, we represent our clients before the competent courts: ownership claims, cancellation or termination of sales, late delivery, hidden defects, eviction, rent recovery and co-ownership litigation. We always favour a negotiated solution when it better protects your interests.

Why involve a lawyer from the start?

Most property disputes stem from insufficient checks before signing. A review upfront costs far less than litigation and saves you from discovering too late a hidden charge, a surface error or a seller who had no right to sell.

Frequently asked questions

Why check the land title before buying?

The land title shows the registered owner and every charge on the property (mortgage, seizure, easement). Checking it before signing prevents you from buying an encumbered property or one sold by someone who does not own it.

Can a foreigner buy property in Morocco?

Yes, a foreigner can in principle buy a home or commercial premises in Morocco. Some categories of land, especially agricultural land, follow specific rules. We review your situation case by case.

What if the developer does not deliver the apartment on time?

The off-plan sale contract and the law govern delivery deadlines. Depending on the contract and the length of the delay, you may claim compensation or even termination of the sale. A formal notice is usually the first step.

Does the firm work outside Rabat?

Yes. The firm is based in Rabat and assists clients in other Moroccan cities as well as Moroccans living abroad.
